1) THE ALPIN RESIDENCE WILL BE BUILT ON LAND WHICH IS DESIGNATED AS A MIXED USE TOURISM AREA.
Under Tyrolean planning law, new domestic properties constructed in mixed use tourism areas must either:
• be registered as a principal place of residence;
• be registered as a work residence; or
• be purchased as a capital investment.
FOR THESE PURPOSES, DOMESTIC PROPERTIES CONSTITUTE:
• a principal place of residence if they are used as a person’s main domicile throughout the year, and are not used exclusively for holiday/leisure purposes.

• a work residence if they:

- are lived in on a temporary basis from time to time; and
-
- serve as place to be used by the owner or the owner’s family members to pursue some form of their work/profession (including, for example, preparation for meetings, drafting documents or reading work related background information).

• a capital investment if they:
- - are not used for holiday purposes but are instead either rented out to individuals who register them as their principal place of residence or their work residence (as described above); or

- are leased to an attached hotel, which may in turn make the property available to guests.
2) NEW DOMESTIC PROPERTY MAY NOT BE ESTABLISHED PURELY FOR HOLIDAY / LEISURE PURPOSES
3) IN LIGHT OF THE PLANNING LAWS BRIEFLY SET OUT ABOVE, Residenz-Bau GmbH will only sell apartments at the Alpin Residence to persons who intend to register the apartment either as a principal place of residence, a work residence, or purchase the apartment as a capital investment.
